Terms and Conditions

These Terms apply to purchases from niclaymancy.com and to related Design Review, custom-order and Design Nook services.

1. About these Terms
By placing an order, submitting a custom-order request or using the Design Nook, you agree to these Terms.
Nothing in these Terms removes or limits rights that cannot lawfully be excluded under consumer law.
2. Who may place an order
You must be at least 18 years old or have permission from a parent, guardian or authorised business representative to place an order.
You must provide accurate contact, account, billing, delivery and product-specification information.
3. Products and descriptions
We take reasonable care to describe products accurately.
Because products may be manufactured, finished or packed by hand:
- Minor surface, colour or dimensional variation may occur.
- Screen colours may differ from physical products.
- Product photographs are illustrative unless the listing states otherwise.
- Measurements are approximate within reasonable manufacturing tolerances.
A variation is not a defect where it does not materially affect the product’s agreed function or specification.
4. Prices and VAT
Prices are displayed in pounds sterling.
Night Imp Claymancy is not currently VAT registered. VAT is therefore not separately charged or shown as recoverable VAT.
Shipping charges are displayed before payment.
International shipping may include duties, tariffs, taxes and carrier handling charges where stated.
5. Orders and contract formation
Submitting an order is an offer to purchase.
An automated acknowledgement confirms that the site received the order. It does not prevent us from cancelling or refunding an order where:
- Payment was not completed.
- The product is unavailable.
- There is an obvious pricing or technical error.
- The requested design cannot reasonably be manufactured.
- The request appears unlawful, infringing, abusive or unsafe.
- Fraud or misuse is suspected.
A binding order is accepted when payment is successfully received and the order enters processing, unless we promptly notify you otherwise and issue a refund.
6. Customer accounts and Design Nook
Custom orders require a customer account.
The Design Nook is used to manage customer Projects, including:
- Messages.
- Reference Images.
- Order Specifications.
- Proofs.
- Proof approval.
- Change requests.
- Shipping information.
You are responsible for protecting your account login details and notifying us if you believe someone has accessed your account without permission.
7. Design Reviews
A Design Review is a preliminary assessment of whether a proposed design may be suitable.
It is not:
- A paid order.
- A guarantee that the final design can be produced.
- A reservation of production time.
- A transfer of intellectual-property rights.
- A commitment to reproduce the reference exactly.
We may recommend changes, decline the request or ask for more information.
8. Customer-supplied material
When you provide an image, logo, drawing, text, photograph or other material, you confirm that:
- You own it or have permission to use it.
- Our use of it to review, design and manufacture the requested product will not infringe another person’s rights.
- It is not unlawful, defamatory, hateful or otherwise prohibited.
You grant Night Imp Claymancy a limited licence to store, adapt and use the supplied material only as reasonably necessary to assess, design, manufacture, communicate about and fulfil your request.
You remain responsible for claims resulting from material you supplied without the necessary rights or permission.
We may refuse or cancel work where there is a reasonable concern about ownership, legality or infringement.
9. Night Imp design files and intellectual property
Unless expressly agreed in writing, purchasing a physical custom product does not transfer ownership of:
- Digital design files.
- CAD or 3D models.
- Manufacturing files.
- Templates.
- Production methods.
- Night Imp artwork or branding.
You receive the physical products included in your order and any use rights expressly stated in the listing or agreement.
10. Specifications and Proof approval
You must review all submitted specifications and Proofs carefully.
Approval authorises us to manufacture using the approved version.
Night Imp Claymancy is not responsible for an error that appeared clearly in an approved Proof or approved specification, except where we failed to manufacture the approved design correctly.
Changes requested after approval may incur additional charges and may delay production.
11. Payment
Available payment methods are shown at checkout.
Payment services may be provided by WooPayments and its payment partner Stripe. Revolut may also be offered after it is approved and activated.
We do not receive or store your full card number.
An order is not treated as paid until the payment provider confirms successful payment.
12. Production and delivery
Production estimates and shipping information are set out in the Shipping and Delivery Policy.
Delivery dates are estimates unless we expressly agree a guaranteed date in writing.
We are not responsible for delay caused by events outside our reasonable control, but we will contact you and take reasonable steps to reduce the effect of the delay.
13. Cancellation and returns
Cancellation, return and refund rights are set out in the Returns, Refunds and Cancellations Policy.
Custom and personalised products cannot normally be returned merely because you changed your mind.
14. Product use
Products must be used only for their intended craft purpose and in accordance with any care or safety information supplied with them.
You are responsible for deciding whether a product is suitable for your material, process and working environment.
Keep small parts and craft tools away from children and vulnerable persons unless appropriately supervised.
15. Website availability
We may update, suspend or withdraw parts of the website for maintenance, security, operational or legal reasons.
We do not guarantee uninterrupted access, but this does not affect an order already accepted.
16. Limitation of liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Deliberate misconduct.
- Breach of rights or remedies that cannot lawfully be excluded.
- Faulty or misdescribed goods where consumer law provides a remedy.
We supply products primarily for domestic, personal and craft-business use. We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Where you use a product for business purposes, we are not liable for loss of profit, revenue, contracts, anticipated savings, business opportunity, goodwill or data, except where the law does not allow that exclusion.
To the fullest extent permitted by law, our total aggregate liability to you for all claims arising from or connected with the website, our services and purchases from us shall not exceed twelve times the total amount you paid to Night Imp Claymancy for purchases during the 12 months immediately preceding the event giving rise to the claim.
This is an aggregate cap for all connected claims, not a separate cap for each claim.
The cap applies only to the extent that it is lawful and fair in the circumstances. It does not override mandatory consumer rights.
17. Personal information
Our collection and use of personal information are explained in the Privacy Policy and Cookie Policy.
18. Changes to these Terms
We may update these Terms where our services, technology, legal obligations or business practices change.
The Terms applying to an order are normally those published when the order was placed, except where a legal change must apply immediately.
19. Governing law
These Terms are governed by the law of Northern Ireland.
The courts of Northern Ireland will have jurisdiction, but consumers retain any right under mandatory law to bring proceedings in another court available to them.
